Chapter1GeneralProvisions
Article1Thismethodisformulatedinaccordancewiththe"ArchivesLawofthePeople'sRepublicofChina"(hereinafterreferredtoasthe"ArchivesLaw").
Article2"ArchivesLaw"mentionedinArticle2ofthe"ArchivesLaw"saidthatthearchivesofvaluetothestateandsocietybelongtothestate,andtheStateArchivesBureaushalldeterminethespecificscopeinconjunctionwithrelevantstatedepartments;theyarecollectivelyowned,Forpersonalownershipandothersthatarenotownedbythestate,thearchivesadministrationdepartmentofthepeople'sgovernmentoftheprovince,autonomousregion,ormunicipalitydirectlyundertheCentralGovernmentshalldeterminethespecificscopeafterobtainingtheconsentoftheStateArchivesAdministration.
Article3Thepermanentcustodyarchivesofthenationalarchivesatalllevelsaremanagedatone,two,andthreelevels,andthespecificstandardsandmanagementmethodsforthegradingareformulatedbytheNationalArchivesAdministration.
Article4WiththeconsentoftheStateArchivesAdministration,variousdepartmentsoftheStateCouncil,andvariousdepartmentsofthepeople’sgovernmentsofprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralGovernment,withtheconsentofthearchivesadministrativedepartmentofthepeople’sgovernmentatthesamelevel,mayformulatespecificmanagementsystemsandMethod.
Article5People’sgovernmentsatandabovethecountylevelshallstrengthentheleadershipofarchiveswork,includetheconstructionofarchivesinthenationaleconomicandsocialdevelopmentplanatthesamelevel,establishandimprovearchivesinstitutions,anddeterminenecessarypersonnelCompileandmakeoverallarrangementsforthefundsneededforthedevelopmentofarchives.
Organizations,organizations,enterprises,institutions,andotherorganizationsshouldstrengthentheirleadershipoverthearchivesworkoftheirunitsandensurethatarchivesworkiscarriedoutinaccordancewiththelaw.
Article6Anyoneofthefollowingdeedsshallberewardedbythepeople’sgovernment,archivesadministrationdepartmentorthisunit:
(1)Collecting,organizing,providingandusingarchivesHavemadesignificantachievements;
(2)Havemadesignificantachievementsintheprotectionandmodernmanagementofarchives;
(3)Havemadeimportantcontributionstoarchivesresearch;
(4)Donatingimportantorpreciousarchivestothecountry;
(5)Fightingagainstviolationsofarchiveslawsandregulationswithoutstandingperformance.
Chapter2ArchivesOrganizationsandTheirResponsibilities
Article7TheNationalArchivesAdministrationshallperformthefollowingdutiesinaccordancewithArticle6Paragraph1oftheArchivesLaw:
(1)Researchandformulatearchivesworkrulesandregulationsandspecificguidelinesandpoliciesinaccordancewithrelevantlaws,administrativeregulationsandrelevantnationalpolicies;
(2)OrganizeandcoordinatethedevelopmentofnationalarchivesundertakingsandformulatedevelopmentComprehensiveplanningandspecialplansforthearchivesbusiness,andorganizetheirimplementation;
(3)Superviseandinspecttheimplementationofrelevantlaws,regulations,andrelevantnationalpolicies,andinvestigateanddealwitharchiveviolationsinaccordancewiththelaw;
(4)Archiveworkofcentralandstateagenciesanddepartments,enterprisesandinstitutionsdirectlyundertheStateCouncil,andnationalsocialorganizationsthatdonotfallwithinthescopeofregistrationinaccordancewithrelevantregulationsofthestate,theworkofnationalarchivesatthecentrallevel,andtheworkofSuperviseandguidetheworkofthearchivesadministrativedepartmentofthepeople'sgovernmentofthemunicipalitydirectlyundertheCentralGovernment;
(5)Organizeandguidearchivestheoryandscientificandtechnologicalresearch,archivespublicityandarchiveseducation,archivesstafftraining;
(6)Organizeandcarryoutinternationalexchangeactivitiesforarchivalwork.
Article8Thearchivesadministrationdepartmentofthelocalpeople'sgovernmentatorabovethecountylevelshallperformthefollowingdutiesinaccordancewiththeprovisionsofArticle6Paragraph2ofthe"ArchivesLaw":
(1)Carryouttherelevantlaws,regulationsandrelevantnationalpolicies;
(2)Formulatethearchivesdevelopmentplanandarchivesworkrulesandregulationsintheadministrativearea,andorganizetheimplementation;
(3)Superviseandguidethearchivesworkinthisadministrativearea,investigateanddealwithillegalarchivesaccordingtolaw;
(4)Organizeandguidearchivestheoryandscienceandtechnologyresearch,archivespublicityandarchiveseducation,archivesinthisadministrativeareaStafftraining.
Article9Thearchivesinstitutionsofgovernmentagencies,organizations,enterprises,institutionsandotherorganizationsshallperformthefollowingdutiesinaccordancewithArticle7ofthe"ArchivesLaw":
(1)ImplementRelevantlaws,regulationsandrelevantnationalpolicies,establishandimprovethearchivesworkrulesandregulationsofthisunit;
(2)Guidetheformation,accumulationandarchivingofdocumentsandmaterialsofthisunit;
(3)Managethearchivesoftheunitinaunifiedway,andtransferthearchivestotherelevantarchivesinaccordancewithregulations;
(4)Superviseandguidethearchivesworkoftheaffiliatedinstitutions.
Article10Thecentralandlocalnationalarchivesatalllevelsareculturalinstitutionsthatcentrallypreserveandmanagearchives.AccordingtoArticle8oftheArchivesLaw,theyundertakethefollowingtasks:
(1)Collectandreceivearchivesthatarevaluabletothecountryandsocietywithinthescopeofthelibrary;
(2)Organizeandkeepthearchivesinstrictaccordancewithregulations;
(3)Developarchiveresourcesinvariousformstoprovideservicesforthesocietytoutilizearchiveresources.
Accordingtorelevantnationalregulations,othertypesofarchivesthathavebeenapprovedtobeestablishedmay,asneeded,undertakethetasksspecifiedintheprecedingparagraph.
Article11:ThenationalarchivesestablishmentprinciplesandlayoutplanshallbeformulatedbytheNationalArchivesBureauandimplementedafterbeingapprovedbytheStateCouncil.
ChapterIIIArchivesManagement
Article12,inaccordancewiththeprovisionsoftheNationalArchivesAdministrationonthefilingofdocumentsandmaterials,thematerialsthatshouldbefiledinafileshallbecollectedbytheunit’sdocumentsorbusinessorganizations.,Andorganizeandfilefiles,andsubmitthemtothearchivesorganizationorarchivesstaffoftheunitforcentralizedmanagementonaregularbasis;nooneisallowedtoclaimitashisownorrefusetofile.
Article13Organizations,organizations,enterprises,institutions,andotherorganizationsshallregularlytransferfilestotherelevantnationalarchivesinaccordancewiththeprovisionsoftheStateArchivesAdministrationonfiletransfer.
Forthearchivesthatbelongtothecentral,provincial,anddistrictedcity-levelnationalarchives,thefilingunitshalltransferthearchivestotherelevantnationalarchiveswithin20yearsfromthedateofformation;Forthearchiveswithinthescopeofthecounty-levelnationalarchives,thefilingunitshalltransferthemtotherelevantcounty-levelnationalarchivesattheexpirationof10yearsfromthedateofformationofthearchives.
Withtheinspectionandconsentofthearchivesadministrationdepartmentatthesamelevel,thetransferperiodofthearchiveswithstrongprofessionalismorconfidentialitycanbeextendedtotherelevantarchives;thearchivesofthecancelledunitorduetopoorstorageconditionsmayleadtoUnsafeorseverelydamagedarchivescanbehandedovertotherelevantarchivesinadvance.
Article14isnotonlyaboutculturalrelics,booksandmaterialsbutalsoarchives.Archivescanexchangeduplicates,copiesorcatalogswithmuseums,libraries,memorialsandotherunits,jointlyholdexhibitions,andjointlyeditandpublishRelevanthistoricalmaterialsorconducthistoricalresearch.
Article15Nationalarchivesatalllevelsshalladoptthefollowingmanagementmeasuresforthearchiveskept:
(1)Establishascientificmanagementsystemandgraduallyrealizethestandardizationandstandardizationofstorage;
(2)Equippedwithspecialwarehousessuitableforsafepreservationofarchives,equippedwithnecessaryfacilitiesforpreventingtheft,fire,stains,andpests;
(3)Accordingtothedifferentgradesofarchives,Takeeffectivemeasurestoprotectandmanagethem;
(4)Accordingtoneedsandpossibilities,providetechnicalequipmentthatmeetstheneedsofmodernizedmanagementofarchives.
Thefilestorageofgovernmentagencies,organizations,enterprises,institutionsandotherorganizationsshallbehandledinaccordancewiththeprovisionsoftheprecedingparagraphasneeded.
Article16ThechangeanddecryptionoftheclassificationofclassifiedarchivesreferredtoinArticle14ofthe"ArchivesLaw"shallbehandledinaccordancewiththe"LawofthePeople'sRepublicofChinaontheProtectionofStateSecrets"anditsimplementationmeasures.
Article17:Archivesownedbythestatecannotbesoldbyanyorganizationorindividual.
State-ownedenterprisesandinstitutionsthatneedtotransferrelevantfilesduetoassettransfershallbehandledinaccordancewithrelevantnationalregulations.
InordertocollectandexchangeChinesearchiveslostabroad,conductinternationalculturalexchanges,andadapttoeconomicconstruction,scientificresearch,andscientificandtechnologicalachievementsFortheneedsofpromotion,theNationalArchivesBureauorthearchivesadministrativedepartmentofthepeople'sgovernmentofaprovince,autonomousregion,ormunicipalitydirectlyundertheCentralGovernmentmaygive,exchange,orsellcopiesofarchivestounitsorindividualsathomeandabroadafterreviewandapprovalbasedontheirpowers.
Article18:Itisstrictlyforbiddentoleavethecountryforthefirst-levelarchivescollectedbythenationalarchivesatalllevels.
Ifthesecondaryarchivescollectedbythenationalarchivesatalllevelsneedtobeexported,theymustbereviewedandapprovedbytheNationalArchivesAdministration.Thetertiaryarchivesheldbythenationalarchivesatalllevels,thearchivesownedbythestateotherthanthefirst,second,andthird-levelarchivesheldbythenationalarchivesatalllevels,andthecollectivelyowned,personallyowned,andothernon-stateownedarchivestothecountryandsocietyArchivesandtheircopiesthatarevaluableforpreservationorshouldbekeptsecret,nationalarchivesatalllevels,agencies,organizations,enterprises,institutions,otherorganizations,andindividualsthatneedtocarry,transportormailoutofthecountrymustpassthroughthepeople’sgovernmentoftheprovince,autonomousregion,ormunicipalitydirectlyundertheCentralGovernment.Thearchivesadministrativedepartmentexaminesandapproves,andthecustomsreleasesitbasedontheapprovaldocument.
Chapter4UtilizationandPublicationofArchives
Article19ThearchiveskeptbynationalarchivesatalllevelsshallbedistributedtothesocietyininstallmentsandbatchesinaccordancewiththerelevantprovisionsoftheArchivesLaw.Open,andatthesametimepublishthecatalogofopenarchives.Startingtimeofarchiveopening:
(1)ArchivesbeforethefoundingofthePeople’sRepublicofChina(includingarchivesfromtheQingDynastyandbeforetheQingDynasty;archivesfromtheRepublicofChinaperiodandrevolutionaryhistoryarchives),sincetheimplementationoftheseMeasuresItwillbeopentothepublicfromJapan.
(2)ThearchivesformedsincethefoundingofthePeople'sRepublicofChinahavebeenopenedtothesocietyfor30yearsfromthedateofformation.
(3)Economic,scientific,technological,culturalandotherarchivescanbeopenedtothesocietyatanytime.
Thearchiveslistedintheprecedingparagraphinvolvenationaldefense,diplomacy,publicsecurity,nationalsecurityandotherimportantnationalinterests,andotherarchivesthathavebeen30yearssincethedateofformationbutthearchivesconsiderittobeunsuitableforopeningafterexpirationWiththeapprovalofthehigher-levelarchivesadministrationdepartment,thearchivescanbepostponedtoopentothepublic.
Article20:Archivesatalllevelsandtypesofarchivesthatprovidesocialuseshouldgraduallybereplacedbymicroforms.Archivesinmicroformsandotherformsofreproductionthatcontainthesignatureorsealofthelegalrepresentativeofthearchivecollectionunitshallhavethesameeffectastheoriginalarchive.
Article21The"utilizationofarchives"inthe"ArchivesLaw"referstothereading,copyingandextractingofarchives.
CitizensandorganizationsofthePeople’sRepublicofChinawhoholdaletterofintroductionorworkpermit,IDcardandotherlegalcertificatescanuseopenfiles.
ForeignersorforeignorganizationstousearchivesthathavebeenopenedinChinamustbeintroducedbytherelevantChinesecompetentauthoritiesandapprovedbythearchivesholdingthearchives.
Organizations,organizations,enterprises,institutions,andotherorganizations,andChinesecitizenswhousetheunopenedarchiveskeptbythearchivesmustbeapprovedbythearchivesthatsavethearchives,andifnecessary,theymustalsobesubjecttotherelevantarchivesadministrativemanagementThedepartmentreviewedandagreed.
Archiveskeptbythearchivesofagencies,organizations,enterprises,institutions,andotherorganizationsthathavenotyetbeentransferredtothearchives.Otheragencies,organizations,enterprises,institutions,andorganizationsaswellasChinesecitizensneedtousethearchivesThedepositoryagrees.
Archivesatalllevelsandtypesofarchivesshouldcreateconvenientconditionsforthesocietytousearchives.Provisionofarchivesforsocialusemaybechargedinaccordancewithregulations.ThechargingstandardsareformulatedbytheStateArchivesAdministrationinconjunctionwiththepricemanagementdepartmentoftheStateCouncil.
Article22"ArchivesLaw"Article22"Announcementofarchives"referstothefirstdisclosureofallorpartoftheoriginaltextofanarchivetothepublicthroughthefollowingforms,orthespecificcontentrecordedinthearchive:
(1)Publishthroughnewspapers,publications,books,audiovisual,electronicandotherpublications;
(2)BroadcastthroughradioandTVstations;
(3)Disseminationthroughthepubliccomputerinformationnetwork;
(4)Readandbroadcastinpublic;
(5)Publishanddistributehistoricalarchives,fulltextorexcerptsofthematerials;

(6)Publiclysell,distributeorpostcopiesofarchives;
(7)Exhibit,publiclydisplayarchivesortheircopies.
Article23Thepublicationofstate-ownedarchivesshallbehandledinaccordancewiththefollowingregulations:
(1)Ifitiskeptinthearchives,itshallbeannouncedbythearchives;ifnecessary,itshallbecollectedItshallbeannouncedaftertheapprovalofthearchiveformingunitortheapprovalofthesuperiorcompetentauthorityofthearchiveformingunit.
(2)Ifitiskeptinthearchivesofeachunit,itshallbeannouncedbyeachunit;ifnecessary,itshallbereportedtothecompetentauthorityatthehigherlevelforapproval.
(3)Unitsandindividualsusingstate-ownedarchiveshavenorighttopublisharchiveswithouttheconsentofthearchives,archivepreservationunit,ortheauthorizationorapprovalofthecompetentauthoritylistedintheprevioustwoitems.
Collective,individual,andothernon-state-ownedarchivesthatarevaluabletothecountryandsociety.Whentheownerannouncestothesociety,heshallabidebythestate’srelevantconfidentialityregulationsandshallnotharmthestate’s,Social,collectiveandothercitizens’interests.
Article24Thepublicationanduseofarchivesdepositedbynationalarchivesatalllevelsshallobtaintheconsentofthearchiveowner.
Article25Usingandpublishingarchivesshallnotviolatethenationallawsandregulationsonintellectualpropertyprotection.
Chapter5PenaltyProvisions
Article26.Ifoneofthefollowingactsiscommitted,thearchivesadministrationdepartmentofthepeople’sgovernmentatorabovethecountylevelshallordercorrectionwithinatimelimit;ifthecircumstancesareserious,theThedirectlyresponsiblepersoninchargeorotherdirectlyresponsiblepersonshallbegivenadministrativesanctionsaccordingtolaw:
(1)Takethedocumentsandmaterialsformedinofficialactivitiesthatshouldbearchivedastheirown,andrefusetohandovertothearchivesorganizationorarchivesstaffArchived;
(2)RefusingtohandoverarchivestotheNationalArchivesinaccordancewithnationalregulations;
(3)Extendingorreducingthescopeofarchiveacceptanceinviolationofnationalregulations;

(4)Donotopenarchivesinaccordancewithnationalregulations;
(5)Knowingthatthearchivesareindangerandfailingtotakemeasures,causingfilelosses;
(6)Archivesstaff,personnelresponsiblefortheleadershipofarchivesworknegligenceoftheirduties,causingarchivelosses.
Article27TheamountoffinesstipulatedinthesecondandthirdparagraphsofArticle24ofthe"ArchivesLaw"isbasedonthevalueandquantityoftherelevantarchives,forunitsrangingfrom10,000yuanto100,000yuanRMB500ormoreandRMB5,000orlessforindividuals.
Article28Violationofthe"ArchivesLaw"andtheseMeasures,resultinginarchivelosses,thearchivesadministrativedepartmentofthepeople'sgovernmentatorabovethecountylevelandrelevantcompetentdepartmentsshallordercompensationforthelossesbasedonthevalueofthelostarchives.
ChapterVISupplementaryProvisions
Article29ThearchivesworkoftheChinesePeople'sLiberationArmyshallbemanagedinaccordancewiththeprinciplesestablishedbythe"ArchivesLaw"andtheseMeasures.
Article30TheseMeasuresshallcomeintoforceonthedateofpromulgation.
Interpretationofthecontent
I.Article1oftheGeneralProvisionsoftheImplementationMeasures:"TheseMeasuresareformulatedinaccordancewiththeprovisionsoftheArchivesLawofthePeople’sRepublicofChina."ExplainstheformulationoftheImplementationMeasuresThebasis,startingpointandgeneralprinciplesofthe“ArchivesLaw”mustbeconsistentwiththe“ImplementationMeasures”whicharetheconcretizationofthe“ArchivesLaw”,whichcaninterpretthe“ArchivesLaw”andcanbereasonablyextendedinaccordancewiththeprovisionsofthe“ArchivesLaw”,Butitmustnotcontradictorconflictwiththe"ArchivesLaw".Inotherwords,whatispermittedbytheArchivesLawcannotbeprohibitedbytheImplementationMeasures;whatisprohibitedbytheArchivesLawcannotbepermittedbytheImplementationMeasures;ifthereisnoprovisionintheArchivesLaw,theImplementationMeasuresshallmakeprovisionsItmustbebasedontheprinciplesoftheArchivesLaw.Inshort,the"ImplementationMeasures"cannotexceedthescopeofthe"ArchivesLaw"andmustmaintainconsistencywiththe"ArchivesLaw".
2.Article2oftheGeneralProvisionsofthe"ImplementationMeasures"explainsthe"archiveswithpreservationvalueforthecountryandsociety"inArticle2ofthe"ArchivesLaw":"ItreferstothevalueofpracticalinvestigationanduseAndarchivesthathaveresearchvalueforhistory,scienceandtechnology,art,education,etc."Forexample,thetext,pictures,filmmaterialandstandardcopiesformedintheprocessoffilmcreationandproductionareallarchivesthathaveresearchvalueforartandaregeneratedduringteaching.Teachingsyllabus,majorsettings,teachingplans,programs,enrollmentguidelines,etc.belongtothearchiveswithresearchvalueforeducation.Here,twopointsneedtobeclarified:First,the"archives"referredtointhe"ArchivesLaw"isnotthedefinitionof"archives"inthegeneralsense,butapartofthe"archives".ArchivesotherthanthoserestrictedbytheArchivesLawarenotincludedinthescopestipulatedbytheArchivesLaw.Althoughtheconceptof"archives"inthe"ArchivesLaw"isnotasbroadastheconceptof"archives"inthegeneralsense,itbasicallysummarizesthecharacteristicsof"archives"inthegeneralsense.Thesecondisthatthearchivesmentionedinthe"ArchivesLaw"stipulatethatthepartofarchiveswithpreservationvaluetothecountryandsocietybelongstothescopeoflegalprotection.Specifically,whatis"archiveswithpreservationvalueforthecountryandsociety"isstipulatedinthe"ImplementationMeasures",andthespecificmanifestationsofthesevaluesaresupplementedandinterpretedastwoaspectsofactualvalueandhistoricalvalue.
3.Article3oftheGeneralProvisionsofthe"ImplementationMeasures"stipulatesthefollowingtwoaspects:First,"People'sgovernmentsatandabovethecountylevelshouldstrengthentheleadershipofarchiveswork,andlisttheconstructionofarchivesundertakings.Enterintothenationaleconomicandsocialdevelopmentplan,establishandimprovearchivesinstitutions,determinethenecessarystaffing,andmakeoverallarrangementsforthefundsneededforthedevelopmentofarchives."Thesecondis"otheragencies,organizations,enterprises,institutions,andorganizationsshouldalsostrengthentheirarchiveswork.Leading,ensuringthedevelopmentofarchiveswork.”Thismeansthatpeople'sgovernmentsatandabovethecountylevelreallyattachimportancetothedevelopmentofarchives,andmustspecificallystrengthentheleadershipofarchiveswork,notjustinthenationaleconomicandsocialdevelopmentplan.Provisions,buttotakethearchivalworkasanundertakinginapracticalandpracticalway,andtomakeoverallarrangementsforthepersonnel,finances,andmaterialsnecessaryforthedevelopmentofarchivalundertakings.Regardingthestaffingissue,theMinistryofLaborandPersonnelandtheNationalArchivesBureauissuedanoticeonthepromulgationofthe"StaffingStandardsforLocalArchivesatAllLevels"(fortrialimplementation)asearlyasFebruary11,1985.Therewereclearprovisions:Ifthelibraryandthearchivesadministrativeagencyworktogether,thestaffingofthearchivesadministrativeagencyshallbedeterminedbygovernmentsatalllevelsbasedonthespecificconditionsoftheareaundertheirjurisdiction,thenumberofpopulations,andthenumberofunitsthatneedtoconductbusinessguidance.""Localarchivesatalllevels""StaffingStandard(Trial)"stipulates:Theestablishmentbaseshallbedeterminedbasedon10,000volumesofarchives(volumes,whichareapproximately150metersinlengthwhenarrangedontheshelf,thatis,anaveragevolumeof1.5cmpervolume,thesamebelow):counties(districts)andcounty-levelcitiesTherearefivepeopleinthearchives,andthecollectionislessthan10,000volumes,andthecompilationisappropriatelyreduced,butnotlessthanthree;sevenareintheregionalcityarchives;tenareinthearchivesofprovinces,autonomousregions,municipalitiesandotherlargecities.Iftherearemorethan10,000volumesbutlessthan300,000volumesinthecollection,onepersonwillbeaddedforevery7,000volumesintheexcess.Forarchiveswithindependentlivingandlogisticswork,inadditiontotheprovisionofbusinesspersonnelinaccordancewiththeaboveregulations,theestablishmentmaybeincreasedbynomorethan20%ofthebusinesspersonnel.Regardingtheoverallarrangementofthefundsrequiredforthedevelopmentofarchives,theNationalDocumentLianfa[1985]No.16"NoticeoftheStatePlanningCommissionandtheStateArchivesAdministrationontheunifiedintegrationoftheconstructionoflocalarchivesatalllevelsintothelocalinfrastructureplan"stipulatesthatlocalpeopleatalllevelsThegovernmentplanningdepartmentmustincorporatethecapitalconstructionoflocalarchivesatalllevelsintothelocalinfrastructureplan.Therequiredinvestmentshouldbecoordinatedandarrangedwithinthelocalinfrastructureinvestment,andstrivetograduallyimprovethearchivalstorageconditions,sothatthearchivalbusinesscanbetterservetheparty’soverallmissionandgeneralpurpose.Targetservice.
